New Local Planning Scheme and Local Planning Strategy

The Shire of Toodyay is in the process of reviewing its existing Local Planning Scheme No. 4 by concurrently preparing a Local Planning Strategy and new updated Local Planning Scheme No. 5.  Both of these important planning documents are proposed to be prepared and introduced following consultation with the community and government agencies. 

REVIEW OF THE LOCAL PLANNING STRATEGY ….. GET INVOLVED!

The major review of the Local Planning Strategy has commenced and the Shire require your input soon. 

The Local Planning Strategy is the highest level local land use document and will set the scene for the sustainable development of the Shire over the next 10 to 15 years.  

Community consultation is an integral component of the development of the new Strategy and will occur during various stages of the project. 

Issues papers have been published designed to provide the community with background information to some of the issues that will be addressed in the new Strategy.

Intensive community consultation is planned for early 2017 approval from the Western Australian Planning Commission to advertise the  draft Strategy.

Community Strategic Plan

The Shire of Toodyay has an adopted Community Strategic Plan 2013 that embraces community aspirations and visions for the future. The Plan evolved from extensive community engagement and includes planning related strategies that are to be considered and implemented by the following Local Planning framework.

Local Planning Strategy

The Local Planning Strategy will provide strategic long term (15 years) planning direction for land use planning in the Shire of Toodyay. The Local Planning Strategy is proposed to reflect the existing regional and local planning framework, provide the rationale for proposed zones and identify key planning issues to be addressed by a new Local Planning Scheme. 
 

Local Planning Scheme No. 5

A review of existing Local Planning Scheme No. 4 is proposed to be replaced by Local Planning Scheme No. 5 that will zone land, include updated mandatory and discretionary development control provisions to implement the short term objectives of Local Planning Strategy and guide development within the Shire of Toodyay.
 
The Local Planning Strategy and new Local Planning Scheme No. 5 are proposed to be prepared and advertised concurrently, subject to Council obtaining all necessary State level approvals. 
 

Local Planning Policies

Local Planning Policies are prepared to provide guidance and flexibility for the formulation, assessment and determination of development applications where the Local Planning Scheme provides for the exercise of discretion in relation to proposed development or the use of land.
 
The Shire has a suite of existing Local Planning Policies that will be reviewed as part of this review process. Any new or proposed changes to Local Planning Policies will be advertised for community input prior to adoption by Council.

At the December 2015 Forum, Council identified the following issues that would form the starting point for further investigation, discussion and consultation:

These issues have been explored and developed as a series of ten Planning Issues Papers including an overview paper.  Each paper contains a summary of the process, information on the topic and questions.  The questions will be used as discussion points leading to formal community consultation once the draft document has been adopted by Council.

What is a Local Planning Scheme?

A Local Planning Scheme is a statutory planning document that zones land and includes mandatory and discretionary development control provisions to guide development within the Shire of Toodyay. The new Local Planning Scheme for the Shire proposes to implement the short term objectives of the proposed Local Planning Strategy. 

Why does the Shire need to update Local Planning Scheme No.4?

Introduced in 2008, Local Planning Scheme No. 4 has been subject to a number of updates (Scheme Amendments).  A more comprehensive review is now required to meet statutory requirements for the review of Local Planning Schemes.

New Local Planning Scheme No. 5 is proposed to be compliant with the recently introduced Planning and Development (Local Planning Schemes) Regulations 2015. While Local Planning Scheme No. 5 is proposed to reflect the existing strategic local and regional planning framework, it provides an opportunity to improve planning outcomes and assessment efficiencies. 

What is a Local Planning Strategy?

A Local Planning Strategy will provide a strategic long term (15 years) planning direction for land use planning in the Shire of Toodyay. The Local Planning Strategy is proposed to reflect the existing regional and local planning framework, provide the rationale for proposed zones and identify key planning issues to be addressed by the new Local Planning Scheme.

The current Local Planning Strategy was adopted on 19 December 2007 and needs to be reviewed to ensure that it provides an up-to-date framework for the development of Local Planning Scheme No. 5.

Why does the Shire need a Local Planning Strategy?

The Shire has a well-developed strategic framework that provides for future growth and development on a range of issues in the form of:

  • Strategic Community Plan;
  • Economic Development Plan;
  • Environmental Management Plan;
  • Heritage Master Plan;
  • Recreation and Sporting Precinct Strategy and Master Plan; and
  • a range of supporting technical studies.

The Shire proposes to review the current Strategy to incorporate these documents and to meet the statutory requirements of the Planning and Development (Local Planning Schemes) Regulations 2015.

How long will it take for the new Local Planning Scheme and Local Planning Strategy to be introduced?

The Shire envisages it will take between two to three years (from June 2015) to prepare and obtain approval for the Local Planning Strategy and new Local Planning Scheme. This short timeframe may be subject to variation due a range of factors including the time required to undertake research and preliminary consultation, preparation of draft documents, Council consideration, advertising, the need to address any issues raised during advertising and the need to obtain state level approvals. 

Will the new Local Planning Scheme and Local Planning Strategy be advertised for community comment?

Yes. Some initial consultation with key stakeholders has already commenced to provide strategic direction and update information on a range of identified issues.

The Shire will undertake advertising and broader community consultation of the new Local Planning Strategy and Local Planning Scheme once Council has received all required state level approvals of draft documents.
